GDPR Notice (EU/UK)

This GDPR Notice applies to individuals located in the European Economic Area (EEA), the United Kingdom, and Switzerland (“Europe”). It supplements the GoAccel Privacy Policy.

1) Roles: Controller vs. Processor

  • For website visitors, prospects, and business contacts, GoAccel is generally the data controller of personal data we collect directly.
  • For customer content and contact lists uploaded into the platform (“Customer Data”), you (our customer) typically act as the controller, and GoAccel acts as a processor processing Customer Data on your instructions, depending on how you use the Services.

2) Legal Bases for Processing

We process personal data under one or more legal bases:

  • Contract: to provide the Services, manage your account, and deliver requested functionality
  • Legitimate interests: to secure, operate, improve, and market our Services, prevent fraud/abuse, and maintain performance (balanced against your rights)
  • Consent: where required (e.g., certain cookies or marketing in some jurisdictions)
  • Legal obligation: to comply with applicable law and lawful requests

3) Messaging Features and Related Data

If Messaging features (such as email or SMS) are enabled, we may process message content and related metadata to provide the feature, maintain opt-out/suppression handling, troubleshoot delivery, and comply with provider/legal requirements. When GoAccel processes Customer Data for Messaging at your direction, you remain responsible for the lawful basis to contact recipients and for providing required notices and consents.

4) Your GDPR Rights

You may have the right to:

  • Access your personal data
  • Correct inaccurate data
  • Request deletion
  • Restrict processing
  • Object to processing (including direct marketing)
  • Data portability
  • Withdraw consent at any time (where processing is based on consent)
  • Lodge a complaint with your supervisory authority

5) International Transfers

Your data may be transferred outside Europe, including to the United States. Where required, we use appropriate safeguards such as Standard Contractual Clauses or equivalent mechanisms.

6) Subprocessors

We may use vetted subprocessors (e.g., hosting, analytics, communications, payment processors) to help deliver the Services. Subprocessors are required to protect data and process it consistent with our instructions and applicable law.

7) Retention

We retain personal data only as long as necessary for the purposes described, unless a longer period is required or permitted by law.
